Terms and Conditions

1. Acceptance of Terms

By accessing and using trivAI ("the Game"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

trivAI is an online multiplayer trivia game where players compete to identify AI-generated answers. The game offers both free and premium subscription tiers with varying features and round limits.

2.5. Scoring System

Points are awarded based on your performance in each round:

  • Correct Answer: +200 points for selecting the correct answer (or most voted answer in Personal dropdown questions)
  • Fooled Someone: +100 points per player who selected your answer as the correct one
  • Spotted the AI (Premium): +150 points for correctly identifying which answer was AI-generated
  • Mistaken for AI (Premium): +100 points per player who thought your answer was the AI-generated one
  • AI Scoring (Premium): The AI earns +200 for correct answer, +100 per player who selects its answer as correct, and +50 per player who fails to identify it

The player with the highest total score after all rounds wins the game.

3. User Accounts

To use trivAI, you must:

  • Create an account with a valid email address
  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Be responsible for all activities under your account

4. Free Trial and Premium Subscriptions

trivAI offers:

  • Free Tier: Includes a limited number of Premium Rounds (50 rounds trial balance for new users).
  • Premium Rounds (one-time purchases): Purchase packs of 100 or 500 Premium Rounds to unlock premium gameplay without a subscription. These rounds are consumed when you play premium games and remain available until used.
  • Premium Subscription: Monthly auto-renewable subscription that provides unlimited premium access while active. The subscription automatically renews each month unless cancelled at least 24 hours before the end of the current billing period.

Premium Features Include: AI-generated questions (including the Personal category), AI Imposter (AI plays as a player), AI Commentary after each round, Global Leaderboard ranking, Answer Interpretation, and No Repeats (unique questions). Premium features are only available during Premium Rounds or with an active subscription.

5. Payment Terms

Payments are processed securely through different payment processors depending on your platform:

  • Web Browsers and Android: Payments are processed through Stripe. We do not store your full payment card details on our servers. Stripe handles all payment processing securely.
  • iOS (iPhone/iPad): Payments are processed through Apple's App Store using In-App Purchase (IAP) via StoreKit. All payments are managed through your Apple ID account. Apple handles all payment processing, and we only receive purchase receipts and transaction confirmations.

By making a purchase, you authorize charges for the selected product(s) through the applicable payment processor.

  • Auto-Renewable Subscriptions: The Unlimited Premium subscription is billed monthly and automatically renews unless cancelled.
    • iOS users: Cancel at least 24 hours before the end of the current period through your Apple ID Account Settings. The subscription will end at the end of the current billing period (no further renewals).
    • Web/Android users: Cancel through the Stripe billing portal accessible from your account page. Cancelling schedules the subscription to end at the end of the current billing period (no further renewals).
  • Reinstate: If you cancelled but your paid period has not ended, you can reinstate to continue uninterrupted (web/Android via Stripe billing portal, iOS via App Store).
  • Payment failures: If a subscription renewal fails, premium access may be disabled immediately until payment is resolved.
    • iOS users: Update payment details through your Apple ID Account Settings.
    • Web/Android users: Update payment details via the Stripe billing portal.
  • One-time Premium Rounds: Delivered immediately after successful payment. Available in packs of 100 or 500 rounds. These rounds are consumed when you play premium games. Any remaining Premium Rounds (trial or purchased packs) remain available even if you later subscribe and then cancel.
  • Pricing: May vary by country/currency and may change over time. Prices displayed in the app reflect local currency and may include applicable taxes. Taxes are calculated and charged by the payment processor (Stripe or Apple) based on your location.
  • Restore Purchases: iOS users can restore previous purchases through the "Restore Purchases" feature in the app, which will restore subscription status and premium rounds balance.

6. Refunds and Disputes

Digital purchases are generally non-refundable once delivered, except where required by law. Refund policies vary by platform:

  • iOS (Apple In-App Purchases): Refunds are handled through Apple's refund policy. You can request a refund through Apple's Report a Problem feature or by contacting Apple Support. Apple's standard refund policy applies.
  • Web/Android (Stripe): Refund requests must be submitted through our support page with your Transaction ID. Refunds are processed at our discretion and in accordance with applicable consumer protection laws.
  • Subscription Cancellations: Cancelling a subscription stops future charges but does not refund the current billing period. You retain access to premium features until the end of the paid period.

If you believe there is a billing error, contact support with your Transaction ID. Chargebacks or payment disputes may result in temporary suspension of premium access while the dispute is investigated.

7. User Conduct

You agree not to:

  • Use the service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to the service or other users' accounts
  • Interfere with or disrupt the service or servers
  • Use automated systems to access the service
  • Share your account credentials with others
  • Engage in any form of cheating, hacking, or exploitation

8. Intellectual Property

All content, features, and functionality of trivAI, including but not limited to text, graphics, logos, and software, are the property of trivAI and are protected by international copyright, trademark, and other intellectual property laws.

9. Privacy

Your use of trivAI is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection and use of your information, including how we handle payment data through Stripe (web/Android) and Apple (iOS).

10. Termination

We reserve the right to terminate or suspend your account and access to the service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

11. Disclaimer of Warranties

trivAI is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, secure, or error-free.

12. Limitation of Liability

To the fullest extent permitted by law, trivAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page. Your continued use of the service after such changes constitutes acceptance of the new Terms.
